In 1979, the EU Parliament won a court case over-ruling (annulling) an EU legal decision (legislative act) because the Council had failed to wait for the EU Parliament’s opinion under the consultation procedure.

According to the consultation procedure, the EU Parliament must be consulted, even though there is no obligation to follow its opinions. Case 138/79.
